Homans said that he did not think McGuire would accept either of these motions, and that formal jury selection would begin at about 12 noon today.
Before the trial can begin, McGuire must also rule on defense motions regarding Flanagan's presentation.
One motion would prevent Flanagan from using certain words and another would allow the defense to view Flanagan's opening statement before he delivers it.
This fall Homans commissioned a survey of potential Suffolk County jurors on their views of abortion as a guide he would have during jury selection.
Homans said then that he would use the poll to determine how certain types of citizens react to the abortion issue.
Homans yesterday declined to comment on whether this poll was a factor in his moving to strike the existing panel of male-dominated panel of jurors. Homans also declined to say how much he will depend on the poll during the jury selection process. He explained that McGuire ruled that he could not speak about the poll
