Tuesday night's abortive riot petered out in East Cambridge Court yesterday morning as Judge Arthur P. Stone handed out five-dollar fines for "disturbing the peace" to six of the seven students arrested in Harvard Square late the night before.
The seventh defendant, Richard N. Brill '42, pleaded not guilty, and will appeal the decision. Two of the seven, Henry M. Maciog '43 and William H. Savage '41, pleaded guilty to the charge, while Royce B. McKinley '42, John G. Buchanan, Jr. 2L, Richard G. Harris '42, and Nicholas Satterlee 2G pleaded not guilty and were fined anyway after a brief trial.
"Keep Away From Police"
In delivering the verdict, Judge Stone said, "Good citizens, when there's trouble they can't help, keep away from the police. You can't maintain your constitutional rights in a mob in Harvard Square at midnight."
When Harris took the witness stand and asked if he had "incited to riot" because he had told two other students who had just been arrested to "keep their chins up," Judge Stone replied, "You're not charged with inciting to riot. You are charged with having disturbed the peace of the Commonwealth by making loud noises and outcries."
