The legal battle of Harvard '42 versus the American Legion passed into the realm of history yesterday when the case of the four Yardlings previously convicted of breaking up a Legion parade of October 6 was quietly nolle pressed when it came up for appeal before Justice Wolch in Superior Court.
Without the formality of jury trial, the defendants, Joseph Ambrose '42, James M. Blumgarton '42, Frank A. Pemberton, Jr. ;42, and John S. Caylor '42, were returned the $10 bonds they had posted, and walked out of court free men. The Legion will not push the case.
After a period of public outcry against the four youths who allegedly dispersed a parade single-handed, they were convicted by Justice Arthur Stone on November 18 of "disrupting public assembly." They appealed, and the case had been hanging fire until yesterday.
