SIX OFFICERS OF ADVOCATE FORCED TO RESIGN POSTS

District Attorney Will Not Puslt Case Into Court--Warns Against Further Offenses

Six officers of the Advocate were forced to resign their positions yesterday as a result of the action taken by Chief Timothy F. Leahy in banning the September issue of the magazine.

Appearing before the Chief and District Attorney Frank G. Volpe at 5 o'clock, John J. Slocum '36, president, Charles A. Haskins '36, treasurer, Gernard Piel '36, Business manager, Robert S. Chafee '36, circulation manager, James LeB. Boyle '36, secretary, and John A. Straus '36, Pegasus, were told that no action would be taken by the state in prosecuting the case on condition that the present officers tender their resignation.

A warning was added by the District Attorney that a repetition of the offense would be met by prosecution. Meanwhile, four hundred extra copies of the banned issue were turned over to the authorities by Slocum, thus definitely closing the case.

Law on Case

The law under which the magazine was banned comes from Chapter 272, Section 30, of the Massachusetts General Statutes, reading, "Whoever sells . . . to a minor . . . a magazine devoted to the publication of or principally made up of criminal news, police reports, or accounts of criminal deeds, or pictures or stories of lust or crime; or exhibits upon a public way or in any other place within the view of a minor . . . shall be punished by imprisonment for not more than two years or by a fine of not less than one hundred or more than one thousand dollars." Other statutes also applied to the case.
